Thank you for your trust and for choosing us to sell your secondhand items. We look forward to giving your items a new life.

This consignment agreement is entered into between Tú a Tú – Secondhand (hereinafter “the store”) and you as the consigning customer.

1. Consignment, Preparation and Sales Period

  • All consigned items are registered in the store’s system and offered for sale with an expected sales period of approximately 5–6 weeks, unless otherwise agreed.

  • Additional processing time may occur for preparation, quality checks, pricing, and storage queue before the items are ready for sale and displayed in the showroom.

  • Pricing is determined either in-store at intake or subsequently via SMS with a price proposal. When prices are sent via SMS, the customer must actively approve by replying “APPROVED” before the items are placed for sale.

  • Price proposals are based on the store’s experience and market assessment to ensure the best possible chance of sale.

  • To increase the likelihood of sale, the store may reduce the price of the items by up to 20% after approximately 4 weeks of the sales period, if this has been agreed with the customer at the time of hand-in.
  • The store reserves the right to decline or remove items after intake if they are later assessed as unsuitable for sale, for example due to defects, condition, seasonality, or mismatch with the store’s assortment. Deselected items can be collected by agreement.
  • As a general rule, consigned items cannot be withdrawn before the end of the sales period, unless otherwise agreed.

2. Commission and Payout

  • The store operates with a standard 50/50 commission, meaning the customer receives 50% of the final sale price, unless otherwise agreed in writing.

  • Payout for sold items is calculated at the end of each month.
    All sales made between the 1st and the last day of the month are compiled and automatically paid out during the first week of the following month to the bank account provided by the customer. If items are sold across multiple months, the customer may receive multiple payouts accordingly.

  • It is the customer’s responsibility to ensure that correct and up-to-date bank details are provided.

3. Unsold Items and Collection

  • Unsold items must be collected no later than 10 days after the end of the sales period.

  • The customer will be notified via SMS when unsold items are ready for collection.

  • Items not collected within the deadline, and where no notice of delay has been given, will be transferred to the store and donated to charity without further compensation, in accordance with this agreement and the store’s terms and conditions.

4. Overview via FleaLover

  • The store uses the FleaLover system. Through the FleaLover app, the customer can track sales and view payout information.

5. Liability and Insurance

  • The store handles, stores, and displays consigned items with reasonable care.

  • Consigned items are not covered by the store’s commercial insurance, and the store cannot be held liable for theft, damage, fire, water damage, or other unforeseen events.

  • Customers are encouraged to check whether their own insurance covers consigned items, especially for high-value goods.

6. Communication and Consent (GDPR)

  • By approving this agreement, the customer consents to being contacted by the store via SMS and/or email regarding:

    • consignment and registration.

    • price approval, sales and payouts.

    • unsold items and collection.

    • service messages related to the consignment.
  • Consent may be withdrawn at any time, subject to necessary communication related to an active consignment.

7. Validity and Acceptance of the Agreement

  • This consignment agreement becomes legally binding when it is approved digitally via SMS by replying “APPROVED”.

  • By approving the agreement, the customer also accepts the store’s applicable Terms & Conditions, including policies regarding commission, pricing, discounts, payouts, and handling of uncollected items.

  • Once the agreement is approved, the store may begin preparation, registration, and sale of the consigned items.
  • Once approved, this consignment agreement applies to all future consignments with Tú a Tú – Secondhand, unless otherwise agreed in writing or unless the terms are updated. In case of changes to the agreement, customers will be informed. Continued consignments after such changes constitute acceptance of the updated terms.
